  • "You" or "Merchant" or "Seller": Refers to individuals, organizations, or companies that apply for, register to use, or use the Rada Events platform to sell products and process payments for their customers.
  • "Customer" or "Buyer": Denotes a person who makes purchases using Rada Events.
  • "Rada Events": Refers to the online platform that enables merchants to sell products to their customers.
  • "Payment Transaction": The process of processing a payment through Rada Events, resulting in the debiting or charging of the purchase amount to a customer and the subsequent crediting of funds to a merchant, minus transaction fees.
  • "Transaction Fees": Refers to the fees charged to the merchant for any product transaction conducted through the Rada Events application.
  • "Product": Encompasses any merchandise, goods, or services listed for sale by a merchant that a customer can pay for using Rada Events.
  • "Purchase Amount": Refers to the amount of a payment transaction for a product, inclusive of any related fees, taxes, or shipping charges.
  • "We" or "Us": Relates to Rada Events.
  • "Rada Events Page": Denotes the merchant's Facebook page with the installed Rada Events app.
  • "Rada Events Account": Refers to the merchant's virtual payment account on Rada Events, through which they can view payments made for products.

4. Registration Requirements

To utilize Rada Events, you must consent to provide and complete all required information elements during the registration process. You are required to register a valid bank account and an M-PESA enabled number to receive remittances from Rada Events. You also agree to provide accurate and up-to-date information. We may request additional information at our discretion to continue your use of Rada Events. By agreeing to these Terms, you represent that you are at least 18 years old and capable of entering into a legally binding agreement.

5. Payment Processing

Rada Events allows merchants to upload products, tickets, or digital content on their Rada Events page and facilitates payment transactions between merchants and customers. Rada Events stores customer information, including payment instruments, and processes payment transactions on behalf of merchants. We may delay payment processing for suspicious transactions or those involving fraud, misconduct, or violations of applicable law or our policies. Merchants authorize Rada Events to charge or debit their Rada Events account for necessary fees related to payment transactions. You acknowledge that your purchases of products are transactions between you and the customer, and Rada Events is not a party to these transactions.

6. Limitation on Use of Service

We reserve the right to change, suspend, or discontinue any aspect of Rada Events at any time without notice or liability. We may also limit or suspend your use of Rada Events at our sole discretion. If we suspend your use, we will attempt to notify you via your registered email address. We do not guarantee uninterrupted or error-free service and are not responsible for service interruptions.

7. Delivery

Merchants must adhere to Rada Events's delivery verification system. Unfulfilled or unverified deliveries may result in payment remittance delays.

8. Rada Events Account Information

You are responsible for maintaining the confidentiality of your Rada Events account. Any transactions conducted by individuals you grant access to your account are your responsibility. You must promptly notify us of any unauthorized use or security breaches related to your Rada Events account.

9. Privacy and Data Protection

Personal information provided to us is subject to Rada Events's Privacy Policy. We are committed to protecting your privacy and complying with data protection regulations.

10. Accuracy, Completeness, and Timeliness of Information

We do not guarantee the accuracy, completeness, or timeliness of information on our site. Your reliance on the material provided is at your own risk. We reserve the right to modify site contents and will inform you of substantial changes affecting your personal information.

12. Service Fees and commision

We do not charge a fee for uploading products, tickets, or digital content on your Rada Events page. Fees apply only when products, tickets, or digital content are purchased through your Rada Events page. We have a no-refund policy for fees after transactions are completed using Rada Events. A commision fee of 8% will charged on your sales.

13. Refund Policy

As a buyer, you are entitled to a full refund under the following circumstances:

  • An event is canceled or postponed.
  • If you purchase digital content that does not match the advertised description.
  • If you purchase a product that does not match the advertised description.

Requests for refunds under other circumstances will be addressed individually. For refund requests, please email [email protected], and we will respond promptly.

14. Disputes

Rada Events provides tools to assist merchants and customers in resolving disputes. If a dispute cannot be resolved, we can mediate it upon request.

15. Termination of Service

We may terminate your use of Rada Events at our discretion without liability, including for inactivity or violation of these Terms or other established policies.

16. Severability

If any provision of these Terms is deemed unlawful or unenforceable, it shall be severed to the extent permitted by applicable law without affecting the validity and enforceability of other provisions.

17. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Kenya.

18. Entire Agreement

These Terms, along with any posted policies, constitute the entire agreement between you and Rada Events, replacing all prior agreements and proposals, whether oral or written.

19. Limitations of Liability; Force Majeure

Rada Events shall not be liable in case of disruptions resulting from Force Majeure. Force Majeure includes acts of nature, government decisions, civil conflicts, and disruptions to telecommunication facilities.

20. Prohibited Uses

Prohibited uses of our site and services include unlawful activities, solicitation of unlawful acts, violations of regulations and laws, infringement of intellectual property rights, harassment, and uploading malicious code. We reserve the right to terminate your use for violating these prohibitions.

21. Modifications of Terms for Buyers

We reserve the right to change these Terms at any time by posting notifications on our website or communicating them to you. Changes become effective after posting and apply to Payment Transactions initiated after the posting date. If you disagree with modifications, your only remedy is to cease using Rada Events.
